Drew Bianchi, a promising medical student, was a passenger in his friend's Toyota Avalon when the vehicle was struck by a truck that crossed the center line, causing a head-on collision with a Gordon Trucking 18-wheeler. The truck driver who caused the collision was operating his vehicle on only three hours of sleep; the second truck driver was talking on his cell phone at the time of impact. Drew sustained major injuries and was rendered a quadriplegic, requiring around-the-clock care. After six weeks of trial, a San Jose, California jury returned a $49,123,375.87 verdict, assigning 35% of the fault to Gordon Trucking, 60% to the other tractor-trailer driver and 5% to the State of California. This case secured the highest non-punitive verdict in California for a traumatic brain injury.
