Was Your Accident Caused by Truck Driver Fatigue?

Truck drivers spend long hours on the road, often driving through the night in order to meet deadlines. Under such immense pressure, many truck drivers fail to comply with the Hours of Service rules created by the U.S. Federal Motor Carrier Safety Administration (FMCSA). For example, during the first eight hours of a shift, truck drivers are required to take a 30-minute break.

Truck drivers must also comply with the following Hours of Service regulations:

  • Truck drivers must not work more than 70 hours a week
  • Truck drivers who work 70 hours a week can get behind the wheel after resting for 34 consecutive hours

There are two major contributors to truck driver fatigue: unrealistic scheduling by a driver’s agency or company, and a desire to make more money by driving longer than what is allowable. The FMCSA analysis division has found that driver fatigue accounts for approximately eight percent of all fatal truck crashes, and for 16 percent of all truck crashes regardless of whether a fatality results. Truck drivers who do not comply with FMCSA regulations can fall asleep behind the wheel or drive under extreme fatigue, which often causes serious trucking accidents. If you were injured in a trucking accident and suspect that driver fatigue was the cause, turn to Scarlett Law Group for immediate help.
