There is no specific discipline known at “Aviation Law” in
the sense that there is a law of the sea (Jones Act), or of the railroad
(FELA). This is particularly true in personal injury cases which arise
from airline accidents. Rather, basic theories and approaches come from
traditional tort concepts such as strict products liability, negligence,
and breach of contract or warranty. To be sure, however, punitive damages
are an important aspect of aviation law.
Notwithstanding the foregoing, there is a great body of law, both common
and legislated, that has developed since the first powered flight at Kitty
Hawk, and particularly, since World War II. The development has been so
extensive, in fact, that at least most major law schools are offering
master of law degrees in aviation and space law. The curricula are highly
specialized and deals with such esoteric matters as international treaties,
air carrier regulation, and particularized administrative law procedures.
